Terms and Conditions
- (Scope)
- The purpose of these general conditions is to regulate the Terms and Conditions of Use of this website operated by W66, LDA, a limited company with registered office at Rua Andrade Corvo, 62, Braga, Portugal, registered in the Commercial Registry Office under the unique registration number and NIPC 515853070, with a share capital of € 2,500.00 (two thousand five hundred euros), (hereinafter referred to as ‘W66, LDA’), as well as the purchase of products through the online shop available therein.
- The purchase of any product in our Online Store W66, LDA implies acceptance of these General Conditions of Sale Online.
- W66, LDA reserves the right to modify these Terms and Conditions of Use without prior notice.
- Any and all alcoholic beverages available for sale in the W66, LDA Online Shop may only be purchased by persons who are of legal age to do so in their country of residence.
- (Use)
- W66, LDA may restrict access to certain pages of the website to authenticated users.
- Authentication consists of the identification of the User, through the introduction of a user e-mail address and a password, mandatory fields to be completed when registering as a User.
- Registration is free of charge and presupposes acceptance of these general terms and conditions of use.
- The password chosen by the User is personal and non-transferable, and any transfer or communication to third parties is prohibited.
- At the end of each use, the User must log out of the password-protected area.
- Whenever the User becomes aware that his/her user data is being used by third parties, he/she must immediately notify W66, LDA.
- (Product Information, Prices and Contents)
- W66, LDA reserves the right to modify, without prior notice and at any time, the information and commercial offer presented on: products, prices, promotions, commercial conditions and services.
- The images illustrating each product on W66, LDA may differ from the product subsequently delivered, and these products are also subject to stock shortages.
- Despite the best efforts of W66, LDA, some products may present an inaccurate price, which is why the company verifies prices each time it processes orders. Consequently, the prices presented on W66, LDA are merely indicative and do not constitute a contractual proposal. If the actual price of the product is lower than the advertised price, W66, LDA will refund the difference. If the price is higher, W66, LDA will inform the customer of this situation by email and will await the customer’s decision to accept the new price or cancel the order within 14 days from the date the email was sent.
- In accordance with Portuguese law, all prices presented on W66, LDA include the VAT rates in force, unless otherwise indicated. Only for resale professionals, the values presented on W66, LDA do not include VAT, being clearly visible the information ‘Without VAT’ next to the price.
- (Contract)
- The information contained in these Terms and Conditions of Use does not constitute an offer of sale, but an invitation to contract, and therefore no contract will exist between W66, LDA and the User until the order is expressly accepted by both parties.
- After placing an order, the User will receive an email with the confirmation of his order, sent to the contact address registered by the customer at the time of formalisation, with all the details about delivery, invoicing, payment information, products and values. W66, LDA suggests all customers to confirm the details of the order. If the customer does not receive the order confirmation email, the customer is requested to contact W66, LDA via the following link [https://wine66.eu/contacto/] so that this notification can be resent to the customer’s email address.
- If any of the details provided by the customer in the order are incorrect and/or the customer wishes to modify any information, provided that the order has not yet been shipped, the customer is requested to contact via the following contacts, atendimento@wine66.eu or mobile +351 915 625 947, as soon as possible so that the modifications requested by the customer can be made internally. Changes to the details of orders already sent will be analysed by the W66, LDA team in order to find, together with the customer, the most appropriate solution.
- All orders at W66, LDA will only be processed after actual receipt of payment. The placing of the order alone does not constitute a reservation of the products.
- If an order cannot be fulfilled in part or in full, W66, LDA will immediately contact the customer to find the most appropriate solution, as provided for in point 5 – Product Availability.
- All orders placed with W66, LDA have a maximum payment period of 24 hours. At the end of this period, the order will be automatically cancelled.
- Orders can be cancelled when the customer expressly requests it through one of the following contacts, prior to shipment of the orders. After confirmation of the dispatch of the order, the customer is requested to contact W66, LDA in order to find, together with the customer, the most suitable solution.
- Through the W66, LDA Online Shop, payments are accepted by Multibank Reference, MBWAY (both for customers with a bank account in Portugal), credit or debit card.
- Order statuses at W66, LDA are divided into 3 phases: Pending, Processing and Completed.
- Pending: Pending receipt of payment in the W66, LDA system;
- In Processing: Phase in which the payment has already been received, and the order is being processed and prepared;
- On Hold: Awaiting further confirmations with the customer to continue with the order. Exceptional phase.
- Completed: The order has been shipped.
- Payments are received in Euros, regardless of the currency in which the transaction was made; conversion fees for payments made in other currencies must be borne by the customer.
- Our customer service department may, in some cases, request documents in order to continue processing the order.
- (Product Availability)
- W66, LDA does not guarantee that the products displayed on the website will be available at the time of order processing, as the order is only processed after confirmation of payment.
- W66, LDA will immediately inform the Customer in case of absolute lack of stock of the ordered product, reserving the right to provide the Customer with information about possible substitute products.
- If the Customer decides not to order the substitute product, W66, LDA will proceed to reimburse any amount paid by the Customer, within a maximum period of 15 (fifteen) days after communication of the cancellation.
- (Shipments and Deliveries and collection in physical shop)
- In general, after dispatch, W66, LDA orders have an average delivery time of:
- Around 72 hours working days in mainland Portugal;
- Approximately 15 working days in the Madeira and Azores Islands;
- Around 4 to 7 working days in mainland Spain;
- Around 6 to 9 working days in the rest of Europe Schengen area;
- After dispatch of the orders, the shipment tracking information will be available in the account of the customers who have placed the order with registration, and an email notification with the shipment tracking link will also be sent to all registered and unregistered customers. If for any reason the customer does not receive the shipping confirmation, he/she should contact W66, LDA via one of the following contacts in order to have all available information about the shipment of the order resent to him/her.
- After notification of dispatch, customers should follow the status of the shipment via the link provided by W66, LDA, to keep track of its progress until the time of delivery of the order, as W66, LDA does not notify every change in the status of the shipment.
- All products shipped by W66, LDA must be verified at the time of delivery. If the customer verifies that the order is damaged, it must be returned immediately to the transport company, duly justifying the reason for the return on the carrier’s delivery note and immediately notifying W66, LDA through one of the following contacts.
- If, after delivery, the customer verifies that any of the items are not in conformity, he/she is requested to contact W66, LDA immediately via email atendimento@wine66.eu, indicating the order number or the number of the document that accompanied the order, attaching images of the packaging as received and of all the items, so that an internal investigation process of the incident can be opened and, in this way, the situation can be resolved as soon as possible.
- W66, LDA is not responsible for shipments to countries where the law does not allow the entry of alcoholic beverages. Customers are responsible for the possible confiscation of the respective orders, as well as the payment of customs duties, if any. In case of return of products, W66, LDA will only reimburse the amount corresponding to the same products. In case of doubt, the customer may contact W66, LDA before placing the order.
- W66, LDA has contracted services with specialised carriers for deliveries in Portugal and Europe in the Schengen area. Every effort is made to meet dispatch and delivery deadlines, however, it should be noted that possible delays in deliveries may be beyond the control of W66, LDA, so it is not possible, in these cases, to guarantee exact delivery times.
- Most deliveries are made during working hours on working days to the delivery address indicated by the customer when placing the order.
- In the event of an unsuccessful delivery attempt by the carrier due to absence, a notice will always be left in the customer’s mailbox with the carrier’s instructions. Depending on the service and the carrier, orders must be picked up at the place indicated in the notice, or the instructions requested in the notice must be followed.
- If for any reason the customer is unable to receive the order or pick it up at the place indicated by the transport company, he/she is requested to contact W66, LDA so that, together, the most appropriate solution can be found.
- In general, after dispatch, W66, LDA orders have an average delivery time of:
- (Returns and Termination Policy)
- W66,LDA recognizes to all its customers the right of termination of contracts concluded with it, allowing them the return, within 30 (thirty) days, of the products purchased in accordance with Decree-Law no. 24/2014, of 14 February with subsequent amendments, the latest wording being Law no. 10/2023, of 03/03.
- The Customer may exercise his right of free resolution by sending an unequivocal statement to that effect (e.g. by letter sent to the headquarters of W66,LDA or by email to atendimento@wine66.eu). For exchanges or returns, the customer is requested to contact W66,LDA by e-mail to atendimento@wine66.eu, indicating the number of the order or the document that accompanied it, taking into account the conditions described below in the following points:
- To return the order, the product must be in perfect condition, and if applicable, with its original packaging, accessories or promotions included, and accompanied by proof of purchase or invoice.
- The return of defective products and erroneous shipments will be accepted, and W66,LDA will be responsible for the shipping and collection costs, provided that the customer communicates this circumstance within 30 (thirty) days from the date of receipt of the product.
- Once the goods have been received at our facilities and after validation of their condition, we will proceed to refund their value according to the method of payment made by the customer, or another solution previously agreed with the customer.
- However, there shall be no reimbursement for any additional shipping costs resulting from the Customer’s choice of a shipping method other than the least expensive standard method offered by W66,LDA.
- W66,LDA reserves the right to withhold reimbursement until receipt of the returned order.
- The Customer must return the order within a maximum period of 14 (fourteen) days from the date on which he/she exercised the right of free cancellation of the contract, assuming in full the costs of return.
- W66,LDA assumes responsibility for defects of origin or raw material of the product purchased, and if this is confirmed by the specialized team of W66,LDA, we will proceed to exchange or return the product at no cost to the customer.
- W66,LDA will not accept the return of the product after it has been used or if it has been altered or modified.
- W66,LDA is not responsible for deficiencies resulting from misuse, negligence, poor storage conditions or force majeure.
- (Protection of personal data)
- W66,LDA complies with current legislation on the protection of personal data, in accordance with the provisions of the Privacy Policy and Protection of Personal Data.
- The User or Client consents to the collection and computer processing of their personal data collected through Registration on the website, in particular the e-mail address and the user name associated with the authentication system, in strict respect and compliance with Law No. 67/98 of 26 October (‘Personal Data Protection Act’).
- By registering, the User undertakes, in accordance with these Terms and Conditions of Use, to provide true, accurate, current and complete information about himself/herself, and his/her identification data must be reliable and current.
- The User is guaranteed the right to access and rectify his or her data at any time and at no additional cost.
- (Intellectual Property)
- All materials, content and software available on the website, such as information, images, illustrations, graphics, names and logos, are the intellectual property of W66,LDA or third parties, and may not be reproduced, modified, distributed, marketed or used in any other way without the prior express written authorisation of W66,LDA or the third party holders of the intellectual property rights over them.
- Any use of the materials, content and software available on the website for a purpose not expressly permitted by these Terms and Conditions of Use will be considered a violation of national and international legislation in force concerning Copyright.
- (User Responsibility)
- W66,LDA is not responsible for the veracity of any information, images, contributions or other materials that users provide through the use of the website.
- The User undertakes to make prudent, careful and responsible use of the website, and not to use it in a way that implies the violation of legally protected rights or positions of W66,LDA or third parties.
- The User shall indemnify W66,LDA for any claim, penalty, fine, judgment or embargo resulting from the User’s failure to comply with intellectual and industrial property laws in the use of the website, as well as for any damage caused to third parties whose fault or negligence is attributable to the User.
- The User is solely responsible for any damage or harm, including loss of data, caused to his system and/or computer equipment resulting from the use of the materials, contents or software available on the website, unless he proves that they were caused intentionally or by gross negligence on the part of W66,LDA.
- W66,LDA is not responsible for any damage or harm that may result (i) from the operation of the User’s computer system and/or equipment, (ii) from difficulties in the use of the website caused, such as delays, interruptions, errors, interferences or suspension of communications, viruses, bugs or operating problems, (iii) from delays caused by deficiencies or overloads of Internet traffic or other electronic systems, (iv) illegitimate actions of third parties, errors or security deficiencies caused by the use of outdated or insecure equipment or browsers, failures in the electronic communications services used by the User, as well as damages, errors and inaccuracies that may result from the malfunction of the same.
- (Links)
- W66,LDA is not responsible for the legality, veracity or quality of any content available on websites to which the link available on its website refers.
- The inclusion of links on the website in no way implies the existence of a relationship between W66,LDA and the owner or operator of the website to which the link refers, nor the approval by W66,LDA of any material, content or software available on said website.
- (Cookies)
- W66,LDA may use cookies to facilitate navigation on the website and to know the User’s preferences.
- However, the use of cookies is communicated to the user beforehand, giving them the possibility of not accepting their use.
- (Jurisdiction and communications)
- These Terms and Conditions of Use are governed by Portuguese law.
- The parties agree to submit any dispute arising from their interpretation or application to the courts of the district of Braga, expressly waiving any other.
- All communications made by W66,LDA will be sent to the e-mail address indicated by the User in the Registration process or used as a credential in the authentication system used.
- Communications are considered to be delivered on the date they are sent.
- (Applicable Law)
- All purchases made on the W66,LDA website are subject to Portuguese law. Any dispute or divergence in the interpretation of the General Conditions of Sale Online will be submitted to the competent Portuguese Court.
- In the event that the Client is located outside mainland Portugal, W66,LDA informs you that any legal proceedings must be brought exclusively in the Portuguese Courts.
- Pursuant to and for the purposes of Article 18 of Law no. 144/2015, of 8 September, we hereby inform you that the RAL entity available is the Lisbon Arbitration Centre for Consumer Disputes, with the following contacts:
